PORT-AU-PRINCE, Haiti (sentinel.ht) – On Sunday, January 10, 2016, the totalitarian regime of Michel Martelly, with haste, installed 92 candidates as deputies of the republic. This Chamber of Deputies and the legislature it is to represent suffers from a lack of legitimacy that will deepen the political crisis in the country.
The legislature, the state institution tasked to make laws, was ironically formed outside of the law. In effect, investors and those interested in trade with Haiti must proceed with caution as any law from this legislature will also share the deficit of legitimacy that its members share.
The Electoral Decree and Constitution of Haiti states clearly that the installation of members of Parliament is to take place after elections have taken place. Notwithstanding the lack of confidence Haitians have in the process, elections are still incomplete with three senatorial contests and several deputy races still awaiting to be held.
Furthermore, the Haitian Constitution requires that the installation of the new Chamber of Deputies take place on the second Monday of January, which would have been January 11, 2016. Due to planned protests against the installation and a boycott by the candidates themselves, the Martelly regime rushed to swear-in the supposed winners a day earlier.
Nearly all political parties, except for the ruling party, Parti Haitien Tet Kale (PHTK), and its ally parties, Bouclier, KID and AAA, asked their candidates to boycott the installation.
The planned protests stemmed from the fact that the electoral process for the 50th Legislature was not in keeping with election standards in Haiti or any where else in the world.
14 Senators were installed later in the week on Thursday, January 14, 2015. Their legitimacy is also tied to the same concerns as the deputies.
To date, a National Assembly, needed to open the legislative calendar was also not held.
The first round of legislative elections was marred by widespread violence, voter intimidation and ballot box stuffing. The second round suffered from a massive fraud operation which resulted in 92% of the tally sheets, for the entire election, consisting of “serious irregularities” that legally should result in their disqualification.
